Terms of Engagement

Nothing on this site is advice, a recommendation, or an offer to act. The content describes our services and approach so you can decide whether to start a conversation. An advisory relationship begins only when a written engagement letter is signed.

Engagements are scoped and priced as fixed advisory mandates agreed in writing before any work starts.

• Fixed fee per engagement — no success fee or outcome-contingent compensation
• Standard payment is 50% at commencement, 50% on delivery
• Scope changes require a written amendment and a revised fee agreement

Deliverables are signed by a named advisor and tied to a documented evidence basis. Where evidence is insufficient to support a conclusion, we state that limitation in the deliverable rather than fill the gap.

• No guarantee of regulatory outcome, approval timeline, or commercial result
• Advice is point-in-time and specific to the jurisdiction and facts assessed
• Regulatory and market conditions change; verify currency before relying on prior work

Confidentiality runs both ways. We hold client information in confidence, protect client identity until the agreed disclosure point, and brief to NDA standard as a matter of course. We expect the same treatment of our methods and deliverables.

Deliverables prepared for an engagement are licensed to the client for their own decision-making. The methods, frameworks, and underlying know-how remain ours. Content on this website is owned by MontEkhi & Company and may not be reproduced without permission.

Advisory work is decision support, not a guarantee of outcome. Responsibility for decisions and their consequences rests with the client. We accept liability only for failure to exercise reasonable professional care, and only to the extent set out in the signed engagement letter.

These terms are governed by the laws of Mongolia. Any dispute is addressed first through good-faith discussion between the parties; failing resolution, it is referred to the competent courts of Mongolia. Engagement-specific terms in a signed engagement letter take precedence over these website terms.
